These Terms & Conditions ("Terms") govern your purchase and use of Alamo Mobile wireless services. Alamo Mobile is a brand of Alamo Broadband Inc. ("Alamo Mobile," "we," "us," or "our"). By activating or using Alamo Mobile services, you agree to these Terms.

1. Description of Service

Alamo Mobile provides wireless voice, messaging, and data services to consumers using networks operated by our wholesale partners. Service availability, speeds, and coverage vary by location and are not guaranteed. Alamo Mobile is a mobile virtual network operator (MVNO) and does not operate the underlying wireless network.

2. Eligibility and Account Setup

To subscribe to Alamo Mobile, you must be at least 18 years of age, provide accurate account information, and maintain a valid payment method on file. You are responsible for the accuracy and currency of your account information. You may not transfer your account to another person without our prior written consent.

3. Service Plans, Charges, and Billing

Plans and Pricing. Current plans, features, and pricing are published on our website and in your customer portal. Prices are exclusive of applicable taxes, surcharges, and regulatory fees unless otherwise stated.

Billing Cycle. Service is billed monthly in advance. Your billing cycle begins on your activation date. Charges for partial months are prorated.

Taxes and Fees. You are responsible for all applicable federal, state, and local taxes, surcharges, regulatory recovery fees, 911 fees, and Universal Service Fund contributions related to your service.

Payment. Payment is due upon receipt of invoice. We may charge a late fee and impose a service suspension or disconnection for accounts that remain unpaid after the grace period specified in your invoice. Returned payments may result in a returned-payment fee.

Automatic Renewal. Unless otherwise specified, monthly service plans automatically renew at the end of each billing cycle at the then-current rate.

Disputes. You must notify us of any billing dispute within 60 days of the invoice date. Unresolved charges remain your responsibility.

4. Device Compatibility and SIM/eSIM

Alamo Mobile operates on specific network technologies. You are responsible for ensuring your device is compatible, unlocked, and supports the required frequency bands. We provide SIM cards and eSIM profiles for activation; you may not reverse engineer, clone, or modify SIM credentials. SIM cards and eSIM profiles remain the property of Alamo Mobile and must be returned or destroyed upon service termination if requested.

5. Number Portability

You have the right to port your telephone number to and from Alamo Mobile, subject to technical and contractual requirements under federal law. Number portability between carriers is typically completed within one business day but is not guaranteed. You are responsible for providing accurate account information to complete a port-in or port-out request.

6. 911 Emergency Services

Important. Wireless 911 service depends on network coverage and the functioning of your device. If your device is out of coverage, has no power, or is disabled for any reason, 911 calls may not complete. Location information transmitted with a 911 call depends on carrier E911 capabilities and your device's GPS functionality. Alamo Mobile cannot guarantee that 911 calls will always be delivered or that accurate location information will always be available.

Alamo Mobile supports 911 emergency calling in accordance with federal regulations.

7. Acceptable Use, Fair Use, and Network Management

Your use of the Services is subject to our Acceptable Use Policy and Fair Use Policy, which are incorporated into these Terms by reference. We reserve the right to manage network traffic, including throttling, prioritization, and suspension of accounts engaged in prohibited activities, as described in those policies.

8. Unlimited Plans, Throttling, and Deprioritization

Plans marketed as "unlimited" are subject to network management practices, including but not limited to:

9. International Usage and Roaming

International roaming and international long-distance calling may be subject to additional charges, geographic restrictions, and network availability. International roaming must be enabled for your account and may require a deposit or credit check. We are not responsible for service availability or quality outside the United States.

10. Service Changes and Termination

Changes by Alamo Mobile. We may modify plans, pricing, features, or these Terms at any time. We will provide at least 30 days' notice of material adverse changes affecting your service or price. If you do not agree to the changes, you may terminate your service without an early termination fee.

Termination by You. You may terminate your service at any time by contacting customer service. No refunds are provided for partial months of service unless required by state law.

Termination by Us. We may suspend or terminate your service immediately for non-payment, fraud, violation of these Terms, violation of the Acceptable Use Policy, or any activity that threatens the network or other customers. We will provide notice of termination except where immediate action is necessary to prevent harm.

11. Disclaimer of Warranties

SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. ALAMO MOBILE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALAMO MOBILE'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES IS LIMITED TO THE AMOUNT YOU PAID US FOR SERVICE IN THE SIX MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

13. Indemnification

You agree to indemnify and hold harmless Alamo Mobile, its affiliates, and its network partners from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, or your violation of the rights of any third party.

14. Dispute Resolution

Arbitration clause pending legal review. The final version will specify a mandatory individual arbitration process with a 30-day opt-out window, in accordance with applicable state and federal law.

Any disputes not subject to arbitration will be resolved in the state or federal courts located in Bexar County, Texas, and both parties consent to the personal jurisdiction of those courts.

15. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Federal telecommunications law and FCC regulations apply where relevant.

16. Entire Agreement

These Terms, together with the Privacy Policy, Acceptable Use Policy, and Fair Use Policy, constitute the entire agreement between you and Alamo Mobile regarding the Services. They supersede any prior understandings or agreements.
