Acceptable Use Policy
This Acceptable Use Policy ("AUP") governs the use of Alamo Mobile wireless services. It applies to all customers and any person using an Alamo Mobile line. This AUP is incorporated by reference into the Terms & Conditions. Violation of this AUP may result in immediate suspension or termination of your service, with or without advance notice.
1. Lawful Use Only
You must use Alamo Mobile services in compliance with all applicable federal, state, and local laws. You may not use the service to:
- Commit fraud, theft, or any other criminal act
- Violate intellectual property rights, including copyright, trademark, and trade secret
- Infringe on the privacy or publicity rights of any person
- Violate export control laws or economic sanctions
- Engage in any activity that is illegal in your jurisdiction or the jurisdiction of the recipient of your communication
2. Prohibited Communications
You may not use Alamo Mobile services to send, receive, or facilitate any of the following:
Harassment and Threats. Threatening, harassing, stalking, or defamatory communications; hate speech; or content that incites violence.
Child Sexual Abuse Material (CSAM). Distribution, receipt, or storage of child sexual abuse material is strictly prohibited and will be reported to law enforcement and NCMEC as required by law.
Unlawful Content. Content that is obscene, libelous, or otherwise unlawful.
Spam and Unsolicited Messaging. Bulk commercial SMS, MMS, or robocalls without the prior express consent of recipients as required by the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act.
Phishing, Spoofing, and Fraud. Messages designed to deceive recipients into disclosing personal information, credentials, or payment details. Caller ID spoofing for fraudulent purposes is prohibited under the Truth in Caller ID Act.
Malware Distribution. Distribution of viruses, worms, trojans, ransomware, or any other malicious software.
3. Network Integrity
You may not use Alamo Mobile services to:
- Attempt to gain unauthorized access to any network, system, or account
- Scan, probe, or penetration-test networks or systems without authorization
- Interfere with or disrupt the service or servers/networks connected to the service
- Bypass or attempt to bypass any security, rate-limiting, or usage-tracking mechanisms
- Use a modified or cloned SIM, eSIM profile, or device identifier (IMEI)
- Operate a SIM farm, call center, or bulk messaging operation
4. Personal Use Only
Alamo Mobile plans are intended for individual personal use. Commercial use is not permitted, including:
- High-volume outbound calling or messaging
- Machine-to-machine (M2M) or Internet of Things (IoT) applications
- Primary connectivity for businesses or fixed locations
- Resale or redistribution of service
Accounts found to be in violation of this restriction may be suspended or terminated.
5. Public Safety and Emergency Services
You may not:
- Make false or prank 911 calls
- Misuse or abuse Text-to-911 services
- Disable or circumvent 911 emergency calling functionality
- Use the service in any way that interferes with public safety communications
6. Third-Party Rights
You are responsible for ensuring that your use of the service does not infringe the rights of third parties. If you receive a takedown notice, copyright complaint, or similar claim, we may forward it to you and require corrective action.
7. Pornographic and Adult Content
We do not prohibit lawful adult content, but you must not distribute it to minors, use it to harass others, or otherwise violate laws regarding obscenity and child protection.
8. Reporting Abuse
If you become aware of a violation of this AUP — for example, if you receive spam or a threatening message from an Alamo Mobile number — please report it immediately:
We investigate all abuse reports and take appropriate action. We may share investigation results with affected parties and law enforcement as required.
9. Enforcement
We may take any of the following actions in response to an AUP violation:
- Warn the customer
- Temporarily throttle or restrict service
- Suspend the account pending investigation
- Terminate the account permanently
- Report the activity to law enforcement or regulatory authorities
- Cooperate with lawful investigations, including providing subscriber information pursuant to legal process
The action taken depends on the severity of the violation, whether it is a first or repeat occurrence, and the immediacy of any ongoing harm.
10. No Refund for Termination Due to AUP Violation
If we terminate your service for a violation of this AUP, you are not entitled to a refund of prepaid service charges, except where required by law.
11. Changes to This Policy
We may update this AUP from time to time to address emerging threats, regulatory changes, or new abuse patterns. Material changes will be communicated at least 30 days in advance.
