Fair Use Policy

Alamo Mobile strives to deliver a fast, reliable, and affordable wireless experience to all of our customers. To do so, we need to manage network resources responsibly. This Fair Use Policy explains how we manage data usage, network congestion, and plan limits. It supplements (and is incorporated by reference into) our Terms & Conditions.

1. Purpose

Wireless network capacity is shared among all customers. A small percentage of users consuming a disproportionately large amount of network resources can degrade service quality for everyone else. This Fair Use Policy balances the needs of individual heavy users with the shared experience of our customer base.

2. "Unlimited" Plans

When we describe a plan feature as "unlimited," we mean you will not be charged overage fees for usage within that plan. Unlimited does not mean uncapped in all circumstances. Unlimited plans are subject to the following network management practices:

a. High-Speed Data Allotment

Each plan includes a high-speed data allotment measured per billing cycle. Your plan's specific allotment is disclosed in your plan details on our website and customer portal. Once you exceed your allotment, service may be restricted for the remainder of the billing cycle. You may purchase a Refill plan to restore additional high-speed data immediately.

b. Video Streaming

Unless otherwise specified in your plan, video streaming may be optimized to standard definition (480p) to preserve network capacity and provide a consistent experience for all users.

c. Network Congestion and Deprioritization

During times and locations of heavy network congestion, customers who have used more than a threshold amount of data in the current billing cycle may experience temporarily reduced speeds compared to other customers (deprioritization). Deprioritization applies only during actual congestion, only to the congested cell or sector, and only to customers above the threshold. Once congestion eases or your billing cycle resets, normal speeds are restored.

The current deprioritization threshold and any post-cap behavior are disclosed in your plan details on our website and customer portal. Thresholds may be adjusted periodically based on network conditions, and any material changes will be communicated to affected customers in advance.

3. Tethering and Mobile Hotspot

Tethering (using your phone as a mobile hotspot to connect other devices) is allowed on plans that include a hotspot allowance. Hotspot data is counted against the plan's high-speed data allotment. Once your data allotment is exhausted, hotspot use may be restricted for the remainder of the billing cycle.

Hotspot usage outside the terms of your plan — for example, connecting a permanent home internet router to circumvent fixed broadband service — is considered abuse and may result in account suspension.

4. Prohibited Usage Patterns

The following usage patterns are prohibited and may result in speed reduction, suspension, or termination of service, with or without notice:

We reserve the right to investigate unusual usage patterns and, if necessary, contact you to discuss alternatives.

5. International Roaming

Unless your plan explicitly includes international roaming, data and voice usage outside the United States is not permitted and may incur additional charges or be blocked at the network level.

6. Enforcement

Before taking action against an account for fair-use concerns, we will normally:

  1. Notify you by email, SMS, or account portal that your usage is approaching or exceeding fair-use limits
  2. Provide an opportunity to adjust your usage or upgrade to a higher-tier plan
  3. Apply speed reductions or account restrictions as described above

In cases of severe abuse, fraud, or immediate threats to network stability, we may take action without advance notice.

7. Changes to This Policy

We may revise this Fair Use Policy from time to time. Material changes will be communicated at least 30 days in advance via email, SMS, or the customer portal.
